Data collection on this website

Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. You can find their contact details in the section “Notice concerning the responsible party” in this privacy policy.

How do we collect your data?

Your data is collected, on the one hand, from information you provide to us. This may, for example, be data you enter into a contact form.

Other data is collected automatically, or after you have given your consent, when you visit the website, by our IT systems. This is primarily technical data (e.g. internet browser, operating system, or time of page access). This data is collected automatically as soon as you enter this website.

What do we use your data for?

Some of the data is collected to ensure the website is provided without errors. Other data may be used to analyse your user behaviour.

What rights do you have regarding your data?

You have the right, at any time, to receive information free of charge about the origin, recipient, and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you can revoke this consent at any time for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

You can contact us at any time regarding this or any further questions on data protection.

Analysis tools and third-party tools

When you visit this website, your browsing behaviour may be statistically evaluated. This is done primarily using what are known as analysis programs.

You can find detailed information on these analysis programs in the following privacy policy.

2. Hosting and content delivery networks (CDN)

We host our website content with the following provider:

Shopify

The provider is Shopify International Limited, Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (hereinafter “Shopify”).

Shopify is a tool for building and hosting websites. When you visit our website, Shopify collects your IP address as well as information about the device and browser you use. Shopify is also used to analyse visitor numbers, visitor sources, and customer behaviour, and to compile user statistics. If you make a purchase on our website, Shopify additionally collects your name, email address, shipping and billing addresses, payment details, and other data related to the purchase (e.g. phone number, order value, etc.). Shopify stores cookies in your browser for these analyses.

For details, see Shopify's privacy policy: https://www.shopify.de/legal/datenschutz.

Shopify is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in the most reliable possible presentation of our website. Where consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TTDSG, insofar as the consent covers the storage of cookies or access to information on the user's device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.

Cloudflare

We use the “Cloudflare” service. The provider is Cloudflare Inc., 101 Townsend St., San Francisco, CA 94107, USA (hereinafter “Cloudflare”).

Cloudflare offers a globally distributed content delivery network with DNS. The transfer of information between your browser and our website is technically routed through Cloudflare's network. This enables Cloudflare to analyse the traffic between your browser and our website and to act as a filter between our servers and potentially malicious traffic from the internet. Cloudflare may also use cookies or other technologies to recognise internet users, which are used solely for the purpose described here.

The use of Cloudflare is based on our legitimate interest in providing our website as securely and free of errors as possible (Art. 6(1)(f) GDPR).

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://www.cloudflare.com/privacypolicy/.

Further information on security and data protection at Cloudflare can be found here: https://www.cloudflare.com/privacypolicy/.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF commits to complying with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?contact=true&id=a2zt0000000GnZKAA0&status=Active

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required under data protection law that ensures this provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

3. General information and mandatory notices

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.

When you use this website, various pieces of personal data are collected. Personal data is data that can be used to personally identify you. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.

Please note that data transmission over the internet (e.g. when communicating by email) may have security gaps. Complete protection of data against access by third parties is not possible.

Notice concerning the responsible party

The party responsible for data processing on this website is:

StepOne Performance GmbH
Aaron Bernstein Platz 3
10117 Berlin
Germany
Email: maazz.dev@gmail.com
Phone: [to follow]

The responsible party is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g. names, email addresses, etc.).

Storage duration

Unless a more specific storage period is mentioned within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for deletion or revoke consent to data processing, your data will be deleted, unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, deletion will take place after these reasons cease to apply.

General information on the legal basis for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, insofar as special categories of data under Art. 9(1) GDPR are processed. In the case of explicit consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your device (e.g. via device fingerprinting), data processing is additionally based on Section 25(1) TTDSG. Consent can be revoked at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. We also process your data where this is necessary to fulfil a legal obligation, on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest under Art. 6(1)(f) GDPR. Information on the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.

Notice regarding data transfer to third countries not considered safe under data protection law, and transfers to US companies not certified under the DPF

Among other things, we use tools from companies based in third countries that are not considered safe under data protection law, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data may be transferred to and processed in these countries. Please note that a level of data protection comparable to that in the EU cannot be guaranteed in third countries that are not considered safe under data protection law.

Please note that the USA, as a safe third country, generally has a level of data protection comparable to that of the EU. A transfer of data to the USA is therefore permissible if the recipient holds certification under the “EU-US Data Privacy Framework” (DPF) or has other suitable additional safeguards in place. Information on transfers to third countries, including the recipients of the data, can be found in this privacy policy.

Recipients of personal data

As part of our business activities, we work with various external parties. This sometimes requires the transfer of personal data to these external parties. We only pass on personal data to external parties if this is necessary for the performance of a contract, if we are legally obliged to do so (e.g. disclosure of data to tax authorities), if we have a legitimate interest in the disclosure under Art. 6(1)(f) GDPR, or if another legal basis permits the data disclosure. When using data processors, we only pass on our customers' personal data on the basis of a valid data processing agreement. In the case of joint processing, a joint controller agreement is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke any consent you have already given at any time. The lawfulness of the data processing carried out up until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME, FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION, TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. YOU CAN FIND THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA, UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING; THIS ALSO APPLIES TO PROFILING, INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION UNDER ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, place of work, or the place of the alleged breach. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent technically feasible.

Access, rectification, and erasure

Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, if applicable, a right to correction or deletion of this data. You can contact us at any time regarding this or any further questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do this. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of erasure.
  • If you have lodged an objection under Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may only be processed – apart from being stored – with your consent, or for the assertion, exercise, or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a member state.

SSL/TLS encryption

For security reasons, and to protect the transmission of confidential content such as orders or enquiries that you send to us as the site operator, this site uses SSL/TLS encryption. You can recognise an encrypted connection by the fact that the browser's address line changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is enabled, the data you transmit to us cannot be read by third parties.

Encrypted payment transactions on this website

If, after concluding a contract subject to a fee, you are obliged to send us your payment details (e.g. account number for direct debit authorisation), this data is required to process the payment.

Payment transactions using common payment methods (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognise an encrypted connection by the fact that the browser's address line changes from “http://” to “https://” and by the lock symbol in your browser line.

With encrypted communication, your payment data transmitted to us cannot be read by third parties.

Objection to promotional emails

We hereby object to the use of contact details published in the context of the legally required imprint for the purpose of sending unsolicited advertising and information material. The operators of these pages expressly reserve the right to take legal action in the event of unsolicited advertising material being sent, such as spam emails.

4. Data collection on this website

Cookies

Our websites use what are known as “cookies”. Cookies are small data packets and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted at the end of your visit. Persistent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies can be used to evaluate user behaviour or for advertising purposes.

Cookies that are required to carry out the electronic communication process, to provide certain functions you desire (e.g. for the shopping cart function), or to optimise the website (e.g. cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in the storage of necessary cookies for the technically error-free and optimised provision of its services. Where consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TTDSG); consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

You can find out which cookies and services are used on this website in this privacy policy.

CookieFirst

Our website uses CookieFirst to obtain your consent for the storage of certain cookies on your device or for the use of certain technologies, and to document this in a manner compliant with data protection law. The provider of this technology is Digital Data Solutions B.V. (CookieFirst), Plantage Middenlaan 42A, 1018 DH Amsterdam, Netherlands (hereinafter “CookieFirst”).

When you enter our website, a connection is established to CookieFirst's servers in order to obtain your consents and other declarations regarding cookie use. CookieFirst then stores a cookie in your browser so that the consents given, or their revocation, can be assigned to you. In doing so, the (anonymised) IP address, the user agent of the browser and operating system, and the URL from which consent was given are processed and integrated into CookieFirst. The data collected in this way is stored until you ask us to delete it, you delete the CookieFirst cookie yourself, or the purpose for storing the data no longer applies. Mandatory statutory retention obligations remain unaffected.

CookieFirst transmits personal data to third-party providers. These include a CDN based in Slovenia, IP geolocation from Romania, and hosting with OVH in Germany and France. CookieFirst is headquartered in Amsterdam, Netherlands.

CookieFirst is used to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6(1) sentence 1(c) GDPR.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required under data protection law that ensures this provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Consent to the use of cookies.

We use cookies so that our website functions properly. In order to obtain your valid consent to the use and storage of cookies in the browser you use to access our website, and to properly document this, we use a consent management platform: CookieFirst. This technology is provided by Digital Data Solutions BV, Plantage Middenlaan 42a, 1018 DH, Amsterdam, Netherlands. Website: https://cookiefirst.com referred to as CookieFirst.

When you access our website, a connection is established with CookieFirst's server to give us the opportunity to obtain your valid consent to the use of certain cookies. CookieFirst then stores a cookie in your browser so that only the cookies you have consented to can be activated, and to properly document this. The processed data is stored until the specified retention period expires or you request that the data be deleted. Notwithstanding this, certain statutory retention periods may apply.

CookieFirst serves to obtain the legally required consent for the use of cookies. The legal basis for this is Article 6(1)(c) of the General Data Protection Regulation (GDPR).

Data processing agreement

We have concluded a data processing agreement with CookieFirst. This is a contract required under data protection law that ensures the data of our website visitors is only processed in accordance with our instructions and in compliance with the GDPR.

Our website and CookieFirst automatically collect and store information in what are known as server log files, which your browser automatically transmits to us. The following data is collected:

  • Your consent status, or the revocation of your consent
  • Your anonymised IP address
  • Information about your browser
  • Information about your device
  • The date and time of your visit to our website
  • The URL of the page on which you saved or updated your consent settings
  • The approximate location of the user who saved their consent preferences
  • A universally unique identifier (UUID) of the website visitor who clicked the banner cookie

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR, provided your enquiry relates to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), where this has been requested; consent can be revoked at any time.

The data you enter in the contact form remains with us until you ask us to delete it, you revoke your consent to storage, or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Enquiries by email, telephone, or fax

If you contact us by email, telephone, or fax, your enquiry, including all resulting personal data (name, enquiry), will be stored and processed by us for the purpose of handling your request.

The data you send to us via enquiries remains with us until you ask us to delete it, you revoke your consent to storage, or the purpose for storing the data no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Communication via WhatsApp

Among other channels, we use the instant messaging service WhatsApp to communicate with our customers and other third parties. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Communication takes place via end-to-end (peer-to-peer) encryption, which prevents WhatsApp or other third parties from gaining access to the content of communications. However, WhatsApp does gain access to metadata generated during the communication process (e.g. sender, recipient, and time). We also note that, according to its own statements, WhatsApp shares its users' personal data with its US-based parent company Meta. Further details on data processing can be found in WhatsApp's privacy policy at: https://www.whatsapp.com/legal/#privacy-policy.

The use of WhatsApp is based on our legitimate interest in the fastest and most effective communication possible with customers, prospective customers, and other business and contractual partners (Art. 6(1)(f) GDPR). Where corresponding consent has been requested, data processing is carried out exclusively on the basis of that consent; it can be revoked at any time with effect for the future.

The content of communications exchanged between you and us on WhatsApp remains with us until you ask us to delete it, you revoke your consent to storage, or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF commits to complying with these data protection standards. The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://www.whatsapp.com/legal/business-data-transfer-addendum.

Wir haben einen Vertrag über Auftragsverarbeitung (AVV) mit dem oben genannten Anbieter geschlossen.

The mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration.

For important changes, such as to the scope of the offer, or in the event of technically necessary changes, we use the email address provided during registration to inform you.

The data entered during registration is processed for the purpose of carrying out the usage relationship established by the registration and, if applicable, for initiating further contracts (Art. 6(1)(b) GDPR).

The data collected during registration is stored by us for as long as you are registered on this website and is then deleted. Statutory retention periods remain unaffected.

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that helps us integrate tracking or statistics tools and other technologies into our website. Google Tag Manager itself does not create user profiles, does not store cookies, and does not perform any independent analyses. It merely serves to manage and deliver the tools integrated through it. However, Google Tag Manager does collect your IP address, which may also be transmitted to Google's parent company in the United States.

Google Tag Manager is used on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the fast and straightforward integration and management of various tools on their website. Where corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TTDSG, insofar as the consent covers the storage of cookies or access to information on the user's device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, length of visit, operating systems used, and the user's origin. This data is combined in a user ID and assigned to the respective device of the website visitor.

Furthermore, with Google Analytics we can, among other things, record your mouse and scroll movements and clicks. Google Analytics also uses various modelling approaches to supplement the collected data sets and employs machine learning technologies in data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transmitted to a Google server in the USA and stored there.

This service is used on the basis of your consent under Art. 6(1)(a) GDPR and Section 25(1) TTDSG. Consent can be revoked at any time.

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

IP anonymisation

Google Analytics IP anonymisation is activated. This means your IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics is not merged with other data from Google.

Browser plug-in

You can prevent the collection and processing of your data by Google by downloading and installing the browser plug-in available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

Google Analytics eCommerce tracking

This website uses the “eCommerce tracking” function of Google Analytics. With the help of eCommerce tracking, the website operator can analyse the purchasing behaviour of website visitors in order to improve their online marketing campaigns. Information such as orders placed, average order values, shipping costs, and the time from viewing to purchasing a product is collected. This data can be combined by Google under a transaction ID that is assigned to the respective user or their device.

Hotjar

This website uses Hotjar. The provider is Hotjar Ltd., Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe (website: https://www.hotjar.com).

Hotjar is a tool for analysing your user behaviour on this website. With Hotjar, we can, among other things, record your mouse and scroll movements and clicks. Hotjar can also determine how long you have remained with the mouse pointer at a particular spot. From this information, Hotjar creates what are known as heatmaps, which can be used to determine which areas of the website are preferred by website visitors.

Furthermore, we can determine how long you remained on a page and when you left it. We can also determine at what point you stopped entering information into a contact form (so-called conversion funnels).

In addition, Hotjar can be used to obtain direct feedback from website visitors. This function serves to improve the website operator's online offerings.

Hotjar uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or the use of device fingerprinting).

Where consent has been obtained, the use of this service is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25 TTDSG. Consent can be revoked at any time. Google Ads

The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads allows us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms on Google (keyword targeting). Furthermore, targeted advertisements can be displayed based on user data available at Google (e.g. location data and interests) (audience targeting). As the website operator, we can quantitatively evaluate this data, for example by analysing which search terms led to our advertisements being displayed and how many advertisements led to corresponding clicks.

This service is used on the basis of your consent under Art. 6(1)(a) GDPR and Section 25(1) TTDSG. Consent can be revoked at any time.

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://policies.google.com/privacy/frameworks and https://privacy.google.com/businesses/controllerterms/mccs/.

The company is certified under the “EU-US Data Privacy Framework” (DPF). This website uses the functions of Google Ads Remarketing. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

With Google Ads Remarketing, we can assign people who interact with our online offering to specific target groups in order to subsequently show them interest-based advertising within the Google advertising network (remarketing or retargeting).

Furthermore, the advertising target groups created with Google Ads Remarketing can be linked with Google's cross-device functions. In this way, interest-based, personalised advertising messages that were tailored to you based on your previous usage and browsing behaviour on one device (e.g. mobile phone) can also be displayed on another of your devices (e.g. tablet or PC).

If you have a Google account, you can object to personalised advertising at the following link: https://www.google.com/settings/ads/onweb/.

This service is used on the basis of your consent under Art. 6(1)(a) GDPR and Section 25(1) TTDSG. Consent can be revoked at any time.

Audience building with customer matching

Among other things, we use Google Ads Remarketing's customer matching feature to build audiences. In doing so, we pass certain customer data (e.g. email addresses) from our customer lists to Google. If the relevant customers are Google users and are logged into their Google account, they will be shown matching advertising messages within the Google network (e.g. on YouTube, Gmail, or in the search engine).

Google Conversion Tracking

This website uses Google Conversion Tracking. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

With the help of Google Conversion Tracking, Google and we can recognise whether the user has carried out certain actions. For example, we can evaluate which buttons on our website were clicked, and how often, and which products were viewed or purchased particularly frequently. This information is used to compile conversion statistics. We learn the total number of users who clicked on our ads and which actions they carried out. We do not receive any information that would allow us to personally identify the user. Google itself uses cookies or comparable recognition technologies for identification.

This service is used on the basis of your consent under Art. 6(1)(a) GDPR and Section 25(1) TTDSG. Consent can be revoked at any time.

Meta Pixel (formerly Facebook Pixel)

This website uses the Facebook/Meta visitor action pixel for conversion measurement. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. However, according to Facebook, the data collected is also transferred to the USA and other third countries.

This makes it possible to track the behaviour of page visitors after they have been redirected to the provider's website by clicking on a Facebook advertisement. This allows the effectiveness of Facebook advertisements to be evaluated for statistical and market research purposes, and future advertising measures to be optimised.

The data collected is anonymous to us as the operator of this website; we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook, so a connection to the respective user profile is possible, and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Policy (https://de-de.facebook.com/about/privacy/). This enables Facebook to place advertisements both on Facebook and outside of Facebook. This use of the data cannot be influenced by us as the page operator.

This service is used on the basis of your consent under Art. 6(1)(a) GDPR and Section 25(1) TTDSG. Consent can be revoked at any time.

We use the advanced matching function within the Meta Pixel.

Advanced matching allows us to transmit various types of data (e.g. place of residence, state, postal code, hashed email addresses, names, gender, date of birth, or phone number) of our customers and prospects, which we collect via our website, to Meta (Facebook). This activation allows us to tailor our advertising campaigns on Facebook even more precisely to people who are interested in our offerings. Advanced matching also improves the attribution of website conversions and expands custom audiences.

Insofar as personal data is collected on our website with the help of the tool described here and passed on to Facebook, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, are jointly responsible for this data processing (Art. 26 GDPR). This joint responsibility is limited exclusively to the collection of the data and its transmission to Facebook. The processing carried out by Facebook after the transmission is not part of the joint responsibility. The obligations incumbent on us jointly have been set out in a joint controller agreement. The wording of the agreement can be found at: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing data protection information when using the Facebook tool and for the data-protection-compliant implementation of the tool on our website. Facebook is responsible for the data security of the Facebook products. You can assert data subject rights (e.g. requests for information) regarding the data processed by Facebook directly with Facebook. If you assert your data subject rights with us, we are obliged to forward them to Facebook.

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://www.facebook.com/legal/EU_data_transfer_addendum and https://de-de.facebook.com/help/566994660333381.

You can find further information on protecting your privacy in Facebook's privacy notices: https://de-de.facebook.com/about/privacy/.

You can also disable the “Custom Audiences” remarketing function in the ad settings area at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen . To do this, you must be logged in to Facebook.

If you do not have a Facebook account, you can disable usage-based advertising from Facebook on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/de/praferenzmanagement/.

We have integrated the Facebook Conversion API on this website. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. However, according to Facebook, the data collected is also transferred to the USA and other third countries.

The Facebook Conversion API enables us to record website visitors' interactions with our website and pass them on to Facebook in order to improve advertising performance on Facebook.

In particular, this involves collecting the time of access, the page accessed, your IP address, and your user agent, as well as, where applicable, further specific data (e.g. products purchased, shopping cart value, and currency). A complete overview of the data that can be collected can be found here: https://developers.facebook.com/docs/marketing-api/conversions-api/parameters.

This service is used on the basis of your consent under Art. 6(1)(a) GDPR and Section 25(1) TTDSG. Consent can be revoked at any time.

With the help of the TikTok Pixel, we can show website visitors who have viewed our offerings interest-based advertising on TikTok (TikTok Ads). 6. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we require an email address from you, as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. No further data is collected, or only on a voluntary basis. We use this data exclusively to send the requested information and do not pass it on to third parties.

The data entered in the newsletter registration form is processed exclusively on the basis of your consent (Art. 6(1)(a) GDPR). You can revoke your consent to the storage of the data, the email address, and its use for sending the newsletter at any time, for example via the “unsubscribe” link in the newsletter. The lawfulness of the data processing operations already carried out remains unaffected by the revocation.

The data you provide us with for the purpose of subscribing to the newsletter is stored by us, or by the newsletter service provider, until you unsubscribe from the newsletter, and is deleted from the newsletter distribution list after unsubscribing or once the purpose no longer applies. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion, within the framework of our legitimate interest under Art. 6(1)(f) GDPR.

Data stored by us for other purposes remains unaffected by this.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us, or by the newsletter service provider, on a blacklist if this is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and is not merged with other data. This serves both your interest and our interest in complying with the statutory requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Storage on the blacklist is not time-limited. You can object to the storage if your interests outweigh our legitimate interest.

With your consent, you can subscribe to our newsletter, with which we inform you about our current, interesting offers. The goods and services advertised are named in the consent declaration.

We use what is known as the double opt-in procedure for registering for our newsletter. This means that after you register, we send an email to the email address provided, asking you to confirm that you wish to receive the newsletter. If you do not confirm your registration within [24 hours], your information will be blocked and automatically deleted after one month. In addition, we store the IP addresses you used and the times of registration and confirmation. The purpose of this procedure is to be able to prove your registration and, if necessary, clarify any possible misuse of your personal data.

The only mandatory information for sending the newsletter is your email address. The provision of further, separately marked data is voluntary and is used to be able to address you personally. After your confirmation, we store your email address for the purpose of sending the newsletter. The legal basis is Art. 6(1) sentence 1(a) GDPR.

You can revoke your consent to receiving the newsletter at any time and unsubscribe from the newsletter. You can declare your revocation by clicking on the link provided in every newsletter email, by email to (maazz.dev@gmail.com), or by sending a message to the contact details given in the imprint.

We use the Klaviyo service from Klaviyo Inc., 225 Franklin St, Floor 10, Boston, MA 02110, USA, to send our newsletters. The processing of the data stored during newsletter registration (email address, possibly name, IP address, date and time of your registration) may also take place in the USA. In the view of the European Court of Justice, an adequate level of data protection cannot currently generally be assumed in the USA.

Klaviyo uses what are known as standard contractual clauses under Art. 46(2) and (3) GDPR as the basis for processing or transferring data to countries outside the EU (https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj?locale=de). Through these clauses, Klaviyo undertakes to comply with the EU data protection standard when processing your data, even if the data is transferred to and processed and stored in third countries such as the USA. You can find more on this on Klaviyo's pages at https://www.klaviyo.com/legal/data-processing-agreement  and  https://www.klaviyo.com/legal/privacy/privacy-notice

Please note that we evaluate your user behaviour when sending the newsletter. For this evaluation, the emails sent contain what are known as web beacons or tracking pixels, which are single-pixel image files stored on our website. For the evaluations, we link the data mentioned in Section 3 and the web beacons with your email address and an individual ID. With the data obtained in this way, we create a user profile in order to tailor the newsletter to your individual interests. In doing so, we record when you read our newsletters, which links you click on in them, and draw conclusions about your personal interests from this.
Right to object

You can object to this tracking at any time by clicking the separate link provided in every email, or by informing us via another contact method by email at maazz.dev@gmail.com. The information is stored for as long as you are subscribed to the newsletter. After unsubscribing, we store the data purely on a statistical and anonymous basis. Such tracking is also not possible if you have disabled the display of images by default in your email program. In this case, the newsletter will not be fully displayed to you and you may not be able to use all functions. If you display the images manually, the tracking described above will take place.

YouTube with expanded data protection

This website embeds videos from the YouTube website. The operator of the website is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of these pages on which YouTube is embedded, a connection is established to YouTube's servers. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to associate your browsing behaviour directly with your personal profile. You can prevent this by logging out of your YouTube account.

We use YouTube in expanded data protection mode. According to YouTube, videos played in expanded data protection mode are not used to personalise browsing on YouTube. Advertisements displayed in expanded data protection mode are also not personalised. No cookies are set in expanded data protection mode. Instead, however, what are known as local storage elements are stored in the user's browser, which, similar to cookies, contain personal data and can be used for recognition purposes. Details on expanded data protection mode can be found here: https://support.google.com/youtube/answer/171780.

After activating a YouTube video, further data processing operations may be triggered over which we have no control.

YouTube is used in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

Further information on data protection at YouTube can be found in their privacy policy at: https://policies.google.com/privacy?hl=de.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

reCAPTCHA is intended to check whether data is entered on this website (e.g. in a contact form) by a human or by an automated program. To do this, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, length of time the website visitor spends on the website, or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run entirely in the background. Website visitors are not notified that an analysis is taking place.

The storage and analysis of the data is carried out on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in protecting its online offerings from abusive automated spying and from spam.

Spotify

This website integrates functions of the Spotify music service. The provider is Spotify AB, Birger Jarlsgatan 61, 113 56 Stockholm, Sweden. You can recognise the Spotify plug-ins by the green logo on this website. An overview of the Spotify plug-ins can be found at: https://developer.spotify.com.

This allows a direct connection to be established between your browser and the Spotify server via the plug-in when you visit this website. Spotify thereby receives the information that you have visited this website with your IP address. If you click the Spotify button while logged into your Spotify account, you can link the content of this website to your Spotify profile. This allows Spotify to associate your visit to this website with your user account.

Please note that Google Analytics cookies are used when using Spotify, meaning your usage data may also be passed on to Google when using Spotify. Google Analytics is a tool of the Google group, based in the USA, for analysing user behaviour. Spotify alone is responsible for this integration. We, as the website operator, have no influence on this processing.

The storage and analysis of the data is carried out on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the appealing acoustic design of its website.

Further information on this can be found in Spotify's privacy policy: https://www.spotify.com/de/legal/privacy-policy/.

We use Zendesk to be able to process your enquiries quickly and efficiently. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

You can submit enquiries with only your email address, without providing your name.

Messages addressed to us remain with us until you ask us to delete them or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Zendesk has Binding Corporate Rules (BCR) approved by the Irish data protection authority. These are binding internal company rules that legitimise the internal transfer of data to third countries outside the EU and EEA. This is a contract required under data protection law that ensures this provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

8. eCommerce and payment providers

Processing of customer and contract data

We collect, process, and use personal customer and contract data for the establishment, content, and modification of our contractual relationships. We collect, process, and use personal data on the use of this website (usage data) only insofar as this is necessary to enable the user to use the service or to bill for it. The legal basis for this is Art. 6(1)(b) GDPR.

The customer data collected is deleted after the order has been completed or the business relationship has ended, and any applicable statutory retention periods have expired. Statutory retention periods remain unaffected.

Data transfer when concluding contracts for online shops, retailers, and shipment of goods

If you order goods from us, we pass on your personal data to the transport company entrusted with delivery and to the payment service provider commissioned to process payment. Only data that the respective service provider needs to fulfil its task is disclosed. The legal basis for this is Art. 6(1)(b) GDPR, which permits the processing of data to fulfil a contract or pre-contractual measures. Where you have given corresponding consent under Art. 6(1)(a) GDPR, we will pass your email address to the transport company entrusted with delivery so that it can inform you by email about the shipping status of your order; you can revoke this consent at any time.

Data transfer when concluding contracts for services and digital content

We only transmit personal data to third parties where this is necessary as part of the performance of the contract, for example to the credit institution commissioned to process payment.

No further transmission of data takes place, or only if you have expressly agreed to the transmission. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.

The basis for data processing is Art. 6(1)(b) GDPR, which permits the processing of data to fulfil a contract or pre-contractual measures.

Credit checks

For purchases on account or other payment methods where we provide advance performance, we may carry out a credit check procedure (scoring). To do this, we transmit your entered data (e.g. name, address, age, or bank details) to a credit agency. The probability of a payment default is determined on the basis of this data. In the event of an excessive risk of payment default, we may refuse the payment method in question.

The credit check is carried out on the basis of contract performance (Art. 6(1)(b) GDPR) and to avoid payment defaults (legitimate interest under Art. 6(1)(f) GDPR). Where consent has been obtained, the credit check is carried out on the basis of this consent (Art. 6(1) GDPR); consent can be revoked at any time.

Payment services

We integrate payment services from third-party companies on our website. When you make a purchase from us, your payment data (e.g. name, payment amount, bank details, credit card number) is processed by the payment service provider for the purpose of processing the payment. The respective contractual and data protection provisions of the respective providers apply to these transactions. The payment service providers are used on the basis of Art. 6(1)(b) GDPR (contract performance) as well as in the interest of the smoothest, most convenient, and secure payment process possible (Art. 6(1)(f) GDPR). Insofar as your consent is requested for certain actions, Art. 6(1)(a) GDPR is the legal basis for the data processing; consents can be revoked at any time for the future.
